Advanced Workplace Mediation

 

Aim

This course builds on the basic mediation skills gained in the Introduction to Workplace Mediation course. Participants will be equipped with the advanced knowledge and skills needed to prepare them for the in-course assessment following which, if assessed to be competent, participants will become CIArb Accredited Workplace Mediators. Participants will gain a thorough understanding of the workplace mediation process and a theoretical understanding of its legal context in addition to developing core mediator skills and confidence to deal with areas such as redundancies, discrimination and unfair dismissal.

 

Delivery

The course is delivered over 3 days, and consists of short lectures, discussion groups, workshops, role-plays and an assessment.

 

Syllabus
  • Workplace conflict - Causes, symptoms and outcomes
  • Why mediate in the workplace?
  • Skills Development - Rebuilding relationships, dealing with emotion, how to empathise and defuse, reframing, assertiveness, managing escalation in a joint meeting and dealing with power imbalance
  • The Mediation Process - Bringing reluctant parties to the table, setting up the mediation, dealing with management and the individual party meeting, the opening, the exploration stage, the option generation stage and getting to agreement
  • The Legal Context - Mediation and the statutory procedures, the issue of confidentiality, mediator paperwork, employment law and the EU, dismissal and discrimination, the settlement agreement and statements of agreed behaviour and the tribunal system
  • Role-Plays
Assessment Syllabus
  • Workplace mediation role play.
  • Demonstration of skill, knowledge and understanding. 
  • Completion of a learning record.
