Module 3 -
Practice, Procedure and Drafting
About the Module
Aim
The aim of this module is to provide sufficient knowledge of and practice in the key procedural elements in an arbitration to permit the giving of independent advice on the process with confidence.
Delivery
This module is delivered by a mixture of home study and face-to-face tutorials.
The module is delivered over a period of four months, and you will be required to attend two tutorials, each lasting 6 hours and 1½ day oral assessment.
Intended learning outcomes
On successful completion of this module you should be able to:
Display a knowledge of the practice and procedure of the arbitral process in depth, including:
- drafting an arbitration agreement;
- detailing procedure;
- making submissions and interlocutory applications;
- making interlocutory decisions;
- presenting and receiving evidence; and
- everything usually required of all the actors in the process except writing a Final Award.
Assessment
There are three elements of assessment in this module.
The first two are written, related to the drafting practice sections of the Module:
- 20% Two Assignments
- 80% 3-hour written examination paper with questions on each of the Sections 1 to 3 of the syllabus.
The third is oral:
- An Assessment Workshop in a 1½-day face-to-face session where situations are presented to you for consideration in groups as to what to do in such circumstances. Experienced tutors will assess your knowledge, judgment and self-presentation skills. Assessment is on a pass or fail basis.
Who should take this module?
To participate in this module, you must:
- be a Member (MCIArb) of the Institute, and
- have passed or been exempt from Module 1 – the law of contract, tort and evidence at under-graduate level or the CIArb examination previously known as Part IIIA, and
- have passed Module 2 – the law of arbitration or the CIArb examination previously known as Part IIB.
CPD
The Law Society and the Bar Council of England and Wales have accredited the Course for 24 hours CPD. If CPD accreditation is required for other organisations, we will be pleased to provide a Certificate of Attendance. Please ask for this on the application form.
