The Chartered Institute of Arbitrators Commercial Arbitration Scheme

A recent addition to the Institute's list of dedicated dispute resolution schemes is the Commercial Arbitration Scheme, which was developed to resolve commercial disputes where one or more party is registered with the scheme.

The Benefits of the Commercial Arbitration Scheme

Benefits of registering with the scheme include:

(a) Significant cost-savings compared to litigation and "ad-hoc" arbitration procedures. The more the scheme is used the more cost-effective it becomes.

(b) Arbitration under the Rules of the scheme provides for quick, binding and cost-effective dispute resolution.

(c) The President or a Vice-President of the Chartered Institute of Arbitrators appoints a Chartered Arbitrator from the Institute's Panel of Chartered Arbitrator's to resolve the dispute.

(d) Applications for arbitration are initially dealt with as documents-only (unless the parties request otherwise), once again this keeps costs to a minimum.

(e) The joining fee covers all branches of a business. For example, if you are a law firm and you register as a member, all of your clients may benefit from using the scheme. Alternatively, if you are a large organisation with several offshoot companies, all of your associated companies may benefits from use of the scheme

The Costs

The costs of registering with the scheme, and subsequently referring a dispute to arbitration are:

(a) One-off joining fee - £300 + VAT

(b) Case Fees:

Total claim of £100,000 or less Institute's fees and expenses of £300 + VAT payable by the Parties, with the application for arbitration. Subject to Rule 9.3, the loser is responsible for the Arbitrator's fees, which are set at £70 per hour, plus VAT (if applicable), plus reasonable travel and out-of-pocket expenses.
Total claim of £100,001 up to £250,000 Institute's fees and expenses of £300 + VAT payable by the Parties, with the application for arbitration. Subject to Rule 9.3, the loser is responsible for the Arbitrator's fees, which are set at £95 per hour, plus VAT (if applicable), plus reasonable travel and out-of-pocket expenses.
Total claim in excess of £250,001 Institute's fees and expenses of £300 + VAT payable by the Parties, with the application for arbitration. Subject to Rule 9.3, the loser is responsible for the Arbitrator's fees, which are set at £120 per hour, plus VAT (if applicable), plus reasonable travel and out-of-pocket expenses.
