MEDIATION ASSESSMENT
Commercial Mediation

Overall aim

To assess participant’s knowledge and practical skills in mediating trial civil and commercial disputes, acting as parties, representative or mediator.

 

Key learning objectives

On successful completion of this module participants will have demonstrated satisfactory competence to:

 

a)

Explain, apply and balance the skills and procedures in civil and commercial mediations as a mediator, including:

  • the range and limitations of the several methods of negotiating and mediating;
  • the significance, rights and responsibilities of the different performers in a mediation and its legal context;
  • the nature of a mediation and its anticipated outcome;
  • the methods of initiating and processing a mediation;
  • using a broad range of mediation shills and applying them appropriately;
  • the status and limitations of a mediation resolution agreement; and
  • writing agreements to mediate and mediation resolution agreements.

Assessment

Assessment of this module is independent of the previous Module: Mediation Training. Participants are assessed in a series of practice scenarios where they act as parties, witnesses or mediator. Assessment is of competence in ‘people skills’, ‘process skills’ and as managers of the process.


Suitable modes of delivery

This module is typically delivered in a 2-day intensive face-to-face assessment of sequential practice situations.

 

Entry qualifications

This Module assesses participants’ understanding and ability to put into practice the skills and procedures detailed in the previous Module: Mediation Training. It is therefore recommended for anyone wishing to be assessed as to mediation competence, whether having taken the previous Module or not.

 

Membership

Participants wishing to progress to Accredited Mediator and Membership [MCIArb] must be Associate members of the Institute [ACIArb].
