Dennis Wise vs Leicester City Football Club

Dennis Wise and Leicester City Football Club will be the first beneficiaries of the Football League's Football Disciplinary Commission (FDC) set up earlier this month.

The FDC is investigating a claim by Dennis Wise for breach of contract against the club which resulted in his much publicised sacking earlier in August. Wise claims he was unfairly dismissed but instead of taking the club to court, the former England midfielder is taking his claim through arbitration under the rules of the FDC.

Just two weeks ago, the Football League published its new Regulations, and invited the Chartered Institute of Arbitrators (CIArb) to assist in disputes between players and clubs to avoid messy legal battles which can ruin the reputation of the game. Under the Regulations, the CIArb will
appoint experienced arbitrators to act as independent chairmen to the FDC, and will also appoint chairman and assistant arbitrators for any subsequent appeals made against the FDC's decisions.

This means that Wise and Leicester will both enjoy a private hearing in front of the best legal decision-making tribunal available- the chairman for this hearing being the Rt Hon. Sir Philip Otton, the well-known and respected retired Court of Appeal judge. In addition, the costs involved in setting-up and running the FDC are but a fraction of what they would have been if the case had been heard through the usual legal channels.

Gregory Hunt, Manager of Dispute Resolution Services at CIArb said: "When the Football League asked us to arrange Friday's hearing earlier this week, we were able to act quickly and appoint one of the UK's leading legal minds to assist. This is because we and our members are committed to assisting parties to resolve their disputes quickly, privately and cost-effectively through whatever means of private dispute resolution is most appropriate for them. The CIArb is delighted to be able to have the opportunity to demonstrate the huge benefits of using arbitration
rather than proceeding through messy, high profile court cases."
