Former CIArb President leads review at UIA’s World Forum of Mediation Centres 28 & 29 March 2008, Milan

THE FORUM OF MEDIATION Centres was created in 2001 by the Mediation Commission of the Union Internationale des Avocats. It brings together the most important commercial mediation and ADR centres from around the world, once every 9 months. The Milan meeting was the 11th since the Forum‘s creation. Stephen Cordery, Ombudsman for the United Technologies Corporation and representative of the InternationalOmbudsman Association, spoke about the use of ombudsmen in corporate situations. One of the particular elements of the “organisational” ombudsmen is their lack of power to influence or direct outcomes. According to Cordery, this offered opportunities for mediators, where “face to face” resolution of disputes was required. Colin Wall, CIArb Past President and Deputy President of the World Forum, led a review of Med-arb; and later, together with Melanie Meilhac of ICC and Frank Carr of the USA, outlined experiences in conflict prevention. A short workshop chaired by Giovanni de Berti, Chairman of CIArb’s Mediation Sub-Committee, discussed the possibility of mediation centres offering conflict prevention services.

 

On Saturday, 29 March, Professor Fulvio Scaparro gave a fascinating lecture on non-verbal communication, leading to a prolonged and vigorous question and answer session – very much verbal but with many non-verbal gestures!

 

The meeting closed with a review of developments from the Centres, chaired by the President of the World Forum, Thierry Garbi. Michael Forbes Smith, CIArb Director-General, also outlined the Institute’s plans for the development of a global benchmark qualification for mediators.
